1. Acceptance of Terms

By accessing or using the Gota Spaces mobile application (the "App"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not use our App. Your use of the App is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Service

Gota Spaces is a digital platform that:

• Allows property owners to list properties for rent, sale, or commercial use.
• Enables users to search and discover properties including residential, commercial, office spaces, gym locations, bank premises, and other real estate.
• Facilitates connections between property owners and potential tenants/buyers by displaying contact information provided by the owners (e.g., phone number, Telegram username).

3. User Responsibilities

For Property Owners/Listers:

You represent and warrant that:

• You own the property or have explicit legal authority to list the property.
• All information provided is accurate, current, and truthful.
• You have all necessary rights and permissions for the photos, videos, and content you upload.
• You will promptly update or remove listings when properties are no longer available.
• You comply with all applicable local, regional, and national laws.
• The contact information you provide is for the sole purpose of facilitating legitimate property inquiries.

For Property Seekers:

You acknowledge that:

• You are responsible for independently verifying all property details, including ownership, legality, condition, and availability, before making any decisions or entering into agreements.
• You should conduct thorough due diligence before visiting properties or transferring any money.
• All communications, negotiations, and transactions are solely between you and the property owner/lister.
• You will use contact information provided by owners only for legitimate property inquiries and will not use it for spam, harassment, or marketing.
• We do not guarantee the accuracy, completeness, safety, or legality of any listing.

4. Prohibited Activities

Users may not:

• Post false, misleading, deceptive, or fraudulent property information.
• List properties you do not own or do not have legal authority to represent.
• Use images, videos, or content that do not accurately represent the listed property or that infringe on any third-party rights.
• Harass, threaten, intimidate, or engage in discriminatory practices against other users.
• Use the App to violate any applicable residential, commercial, or anti-discrimination laws.
• Use the App for any illegal, unauthorized, or fraudulent purpose.
• Attempt to scrape, copy, or replicate the App's content for commercial use without permission.
• Interfere with or disrupt the App's servers or networks.

6. Intellectual Property

• User Content: Property owners and users retain all rights to their photos, descriptions, and other content they post ("User Content"). By posting User Content, you grant Gota Spaces a non-exclusive, worldwide, royalty-free license to host, store, and display your content within the App.
• App Ownership: The App itself, including its original code, design, graphics, and logo, is and remains the property of Gota Spaces. You may not copy, modify, or reverse engineer any part of the App.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Gota Spaces and its affiliates... shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues... resulting from:

1. Your use or inability to use the App.
2. Any inaccurate, fraudulent, misleading, or incomplete property listings.
3. Any conduct or content of any third party on the App, including offensive, illegal, or fraudulent behavior.
4. Any dispute, damage, loss, or injury resulting from communications, meetings, property viewings, or transactions between users.
5. Any illegal or unauthorized use of the platform by a user.
6. The quality, safety, or legality of any listed property.

8. User Conduct and Safety

Your safety is your responsibility.

• Verification: Always verify property details, ownership, and the identity of the person you are dealing with independently.
• Meetings: When viewing a property, consider meeting in a public place first or bringing a companion. Let someone know your plans.
• Financial Transactions: Exercise extreme caution. Do not transfer money without proper, verifiable documentation and a signed agreement. We strongly recommend using legal professionals to draft contracts.
• Reporting: Report any suspicious listings, users, or behavior immediately to support@gotaspaces.com.

9. Content Moderation and Enforcement

We reserve the right, but have no obligation, to:

• Monitor the App for prohibited content or activities.
• Remove, edit, or reject any listing or content that we believe violates these Terms.
• Suspend or permanently terminate the accounts of users who violate these Terms.
• Cooperate fully with law enforcement authorities.

10. Termination & Changes to Terms

We may terminate or suspend your access to our App immediately, without prior notice or liability, for any reason. You may delete your account at any time by following the in-app procedure described in our Privacy Policy.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

11. Governing Law & Contact Info

These Terms shall be governed and construed in accordance with the laws of Ethiopia. Any legal suit or proceeding shall be instituted exclusively in the federal or state courts located in Addis Ababa, Ethiopia.

12. Disclaimer of Warranties

THE APP AND ALL CONTENT, INCLUDING ALL LISTINGS, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED... WE DO NOT WARRANT THAT: (A) THE APP WILL FUNCTION UNINTERRUPTED; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE RESULTS OF USING THE APP WILL MEET YOUR REQUIREMENTS; OR (D) PROPERTY LISTINGS ARE ACCURATE, LEGAL, SAFE, OR THAT THE LISTER HAS THE RIGHT TO LIST THE PROPERTY. YOUR USE OF THE APP IS SOLELY AT YOUR OWN RISK.
